Because a fan-art is any artistic work that has a creative process, mostly in its visual detail, based in characters, clothing, epochs, etc. that gives birth to new narrations and the term comes from such definition: "Fan-Art". It can also be called the recreation of a character already in existance in a way that focus in highlighting the respect to another artis, or to show the dominated techniques but without cheating of the fantasy to be just like someone else.

Copying, on the other hand, is not that difficult, but its way of being used may say a lot of an artist. For example, with a replica, or copy you get revenue, being the copy an exact replica of the original and technique of its entire work, be it visual, written, audiovisual, etc. With the only purpose of highlighting the ability of duplicating a result and therefore lacks any merit in and of itself.
In artists' terms, fan-art is the most used and less frowned upon because no one is like another but the variety is what enriches the artists guild, so the phrase:

A pencil drawing is not considered a work of art per se, but the basic of any visual work or derivatives a pencil in the hands of an artist may be one of the most important tools, like the Photoshop effects:

It isn't required to have the best equipment from the beginning, but I'm not going to lie: Who doesn't want to have everything! Anyway, back on topic, copying, I repeat, does not have any merit in itself, but fan-art is considered a type of innovation and quite a challenge.
Just like painting, sculpting, chiaroscuro, music, literature, etc. that require a mental and physical process, the ones who do fan-art of something that already exists also use the same mental and physical process.
Conclusion: Anyone that makes fan-art, a reference, or their own work, is in my opinion an artist.
